Wimple Auto Transport
Terms of Service
Effective Date: July 17, 2025
Definitions
For the purposes of these Terms of Service, the following terms are defined as follows:
- "Company" refers to Wimple LLC, doing business as Wimple Auto Transport.
- "Customer" refers to the individual or entity who requests or purchases transport services through the Company.
- "Carrier" means a motor carrier of property, as defined at 49 U.S.C. §13102(14), duly licensed by the Department of Transportation (DOT).
- "Shipment" refers to the vehicle designated by the Customer for transport.
- "Order Confirmation" means the written or digital confirmation issued by the Company that outlines the transport details, price, and route.
- "Bill of Lading (BOL)" is the inspection and transport receipt document signed at both pickup and delivery, used to record the condition of the vehicle.
- "Transport Service" refers to the service of arranging and coordinating the shipment of a vehicle through a third-party carrier.
- "Website" refers to the Company's online platform at www.wimplesolutions.com.
- "C.O.D." means collect on delivery or payment upon delivery.
- "Inoperable" refers to a condition in which a Shipment cannot function or be driven under its own power, including but not limited to flat tires, engine or transmission failure, or disconnected steering or braking systems.
1. Acceptance of Terms
By accessing or using the services provided by Wimple LLC ("Wimple Auto Transport"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. Your use of our website or services constitutes automatic acceptance of these Terms in full. In the event of a conflict between these Terms and any other document, including a Carrier's Bill of Lading, these Terms shall govern.
We reserve the right to modify or update these Terms at any time. Any changes will be posted on our website with a revised effective date. Continued use of our services after such updates constitutes your acceptance of the revised Terms. It is your responsibility to review the Terms periodically.
2. Services Provided
Wimple Auto Transport, a service operated by Wimple LLC, acts solely as a licensed auto transport broker. We coordinate vehicle shipping services by connecting customers with qualified and insured carriers across the United States. Wimple does not operate its own fleet and is not a motor carrier.
We offer both open and enclosed vehicle transport options for standard and specialty vehicles. All shipments are handled by third-party carriers selected based on availability, service quality, and compliance with federal regulations.
Our website features a real-time cost calculator that allows customers to receive instant, data-driven quotes. Once the Customer receives a quote, that quote is considered final and binding, unless inaccurate or incomplete information was provided. This includes, but is not limited to, incorrect pickup or delivery addresses, oversized or modified vehicles, or undisclosed vehicle condition.
Exclusions from Standard Service
The quoted price does not include loading or unloading assistance, storage, winching, or use of special equipment, unless such services were explicitly requested and noted in the booking confirmation. These services may be available through the Carrier at an additional cost, which the Customer agrees to pay.
If the Customer selects "operable" during booking, it is assumed the vehicle can start, steer, and roll under its own power at the time of pickup and delivery. If the vehicle is found to be inoperable—including but not limited to flat tires, dead battery, engine failure, or brake issues—additional fees may apply. These fees are the Customer's responsibility.
3. User Responsibilities and Conduct
By using our services, you agree to provide accurate and complete information. Customers are responsible for:
- Being available or designating a representative at pickup and delivery locations
- Ensuring the vehicle is prepared for transport and disarmed if equipped with an alarm
- Removing or securing all loose accessories or aftermarket parts
- Paying for service in accordance with the agreed terms
Prohibited behaviors include, but are not limited to:
- Submitting false or misleading booking information
- Initiating chargebacks without first attempting resolution
- Including illegal, hazardous, or contraband items in the vehicle
- Abusing or harassing any Carrier or Company representative
Wimple LLC and the Carrier are not responsible for personal items, including electronics, valuables, cash, or documents, left in the vehicle. One item of up to 100 lbs may be shipped in the trunk at no additional charge, provided Wimple LLC is notified in advance. No flammable, hazardous, illegal, or prohibited materials are allowed. Customers do so at their own risk.
Wimple LLC reserves the right to cancel or deny service and pursue legal remedies in the event of any violation.
4. Payment Terms
Two payment options are available:
Cash Price Option: Partial upfront payment by card, with remaining balance due to the driver in cash or certified funds upon delivery.
Regular Price Option: Full payment by credit/debit card once a Carrier is assigned. No upfront payment.
Cancellation: Free if requested 24+ hours before pickup. Cancellations made within 24 hours are subject to a $75 fee.
5. Shipping Process & Carrier Liability
Estimated pickup and delivery windows are provided, but cannot be guaranteed. Delays caused by weather, traffic, carrier mechanical issues, or acts of God are outside Wimple LLC's control. Wimple is not liable for losses or costs related to delays.
All Carriers are fully insured. Customers must inspect the vehicle at pickup and delivery, document any damages on the BOL, and take timestamped photos. Claims must be filed directly with the Carrier. Wimple provides insurance contact information but does not handle claims.
6. Bill of Lading (BOL) & Inspection
The BOL is the legal condition report for the vehicle. It must be signed by the Customer or authorized representative at pickup and delivery. Any damage must be noted at the time of delivery and supported by photographic evidence. Failing to do so may void a claim.
7. Storage, Redelivery & Carrier Lien
If the Customer refuses delivery or fails to pay, the vehicle may be placed in storage at their expense. The Carrier may also exercise a possessory lien and retain the vehicle until full payment is made. Wimple is not responsible for any resulting charges.
8. Late Payment & Interest
Outstanding balances will accrue 1.5% interest monthly (18% annually) and may incur a $25 late fee. Customers are responsible for all collection and legal costs.
9. Arbitration & Class Action Waiver
Unresolved disputes will be settled by binding arbitration under the AAA in Dallas County, TX. A 30-day written notice of intent to arbitrate must be sent to Wimple LLC before initiating arbitration. Small claims court remains available for qualifying claims.
Class action lawsuits are waived. Each party pays their own legal fees unless the arbitrator determines otherwise.
10. Legal Compliance & Indemnification
USDOT Number: 4089002
MC Number: 1557261
Wimple LLC complies with all FMCSA regulations. We are a broker and assume no liability for cargo loss or carrier issues. Customers agree to comply with applicable federal, state, and local transport laws.
Customers agree to indemnify and hold harmless Wimple LLC, its employees, and contractors from any liability arising from breach of these Terms, inclusion of prohibited items, or damage caused by vehicle condition or contents.
11. Miscellaneous
Severability: Invalid provisions do not affect the enforceability of remaining terms.
Entire Agreement: This document is the complete and binding agreement.
Waiver: Failure to enforce a term does not waive Wimple's right to enforce it later.
Assignment: Customer rights under these Terms may not be transferred without written consent.
